Need some help for laws

I'm trying to find some information to print so I can bring it into my employer tomorrow and stick their BS up their butts. I live in Vermont... am listed as a part-time employee with zero benefits. This means they cannot legally have me work more than 38 hours per week. I tried getting a second job... told them what days I wouldn't be available and they told me if I wanted to take on a second job they would take that as my 2 week notice because they were not going to ALLOW me to take on a second job... as an f'n part-time employee! I called just barely to get my schedule for this coming week.... another 6 day, 50 hour week! I know the Vermont labor laws are pretty much non-existent, but I KNOW these people are breaking several labor laws but I cannot find the forms I need to print so I can get my own crap taken care of. I was told directly by the second man in charge if I wanted another job... as a part-time employee they could not tell me no. How ever, since he's not in charge of staff... the witch who is is trying to play games with me. I told her very politely if they wanted to list me as full-time I would gladly take it and not bother with a second job, and would also take the sick time and vacation time.... I was told no... then was told I could quit if I didn't like it. If anyone can help me... I would REALLY appreciate it. Cause I'm going to the federal labor board on Monday if I don't get through to her by tomorrow morning.

Cause I'm going to the federal labor board on Monday if I don't get through to her by tomorrow morning.[/QUOTE] if i were you, I would get documentation for your first job that they wont 'let' you have a second job. then call a labor attorney (call your local bar association to have one recommended). tell them your story and they will tell you what kind of case you have. part time job can not tell you you can have another job. but if they are a hire at will state (many are) they can chose to fire you for any reason. but they can't point blank tell you that you can't make a living.

they cannot tell you that you can't get another job. number one its unethical for a business to do so. if you are in a union you can talk to your union rep about what course of action you can take but federal law (I think I'm not sure) says that a company can't specifically say "no you can't take on another job or your fired' type of thing. edit: and its also a violation of federal labor laws

Figured as much. I know Vermont is one of those states where there's no rules to most things there should even be a base rule for... but I had this job fined 10 grand for bounced checks a while back... I'm seriously amazed that manager is trying to mess with me again. I'm not in the union... but my father was for 17 years. He told me that since I went to my immediate manager three times about this... went over her head... and then had her boss sit with her and me and go over this... that they know what my situation is and if they put me on the schedule I should just call out on Saturdays. One thing I forgot... they're giving me Fridays off (only day off a week, too) but won't give me the Saturday. Now I have been going FAR beyond the call of duty with this job, but they broke the straw here and I'm not being nice anymore. There's just no other work around here aside from flipping burgers, considering I still can't walk straight... and I'm sure I can nail them on discrimination since I was told I didn't get a promotion because I was walking with a cane and they didn't want me as a supervisor walking the floor like that.

If as ya say you go beyond the call of duty and they are working ya ragged with 50 hours a week (actually now that I think about it, if the pay is so bad that you work 50 hours a week and can't pay the bills I would quit!) - but back to the point, it sounds like they need you more than you need them. So I would get the second job and call their bluff. If they are not bluffing you lose a crappy job. I have lost a TON of these. Ain't no biggie. Then you will already have the second job so ya not unemployed, and ya just have to find another second job. - if ya can find a union job. I am in a union and if stops alot of the BS of the guys in tie's pushing you around. Good luck man!

Find an attorney or advocate in your area and set up a meeting for your next day off. Someone who does this stuff for a living is going to have a much better idea of your options then a few guys on the internet. A consultation should be available free of charge, and would at the very least give you an idea of what options you have. If you haven't already, DOCUMENT EVERYTHING. "I talked to [Supervisor X] on [Day Y], who told me [Bull**** Z]." It could be useful later, and at the very least a thick stack of notes looks awfully intimidating when you take it to a higher-up and state your demands further down the line. EDIT: This is a little bit of a Hail Mary play, but try talking to the union even though you aren't a member. Being the son of a long-term member and being stuck in so obviously bad a situation, there's a chance they could stick up for you anyway. I'm guessing that you're not a member because you're not a full-time employee?

Quite familiar with this type of situation. Let me take a wild guess and say you work in retail. Your best bet is to go to the break room and look at the labor law posters that everyone walks by each day and never notices, take down the hotline number, give them a call and calmly explain the situation. I promise, they will be more than happy to assist you with your problem. On a side note, if your employer doesn't have these posters posted in an area easily accesable to employees, then they are in violation of yet another law and you'll probablly be able to find out who to contact in your local phone book or by calling your local city hall. Good Luck! PS - Your employers cannot fire you or execute any other disciplinary actions if they find out that you dropped a dime on them, don't let them intimidate you.

Not looking so much for "guys on a website" to tell me I'm right... but I can't find the page I'm looking for online, all my web searches are coming up with crap. Mostly all I'm finding are websites where guys who think they're lawyers telling everyone with a problem "Tough crap, your state can do what they want because there are no definitive laws." I know I have a definitive piece of paper in my folder at work (which I'll grab on Sunday morning) with my boss writing that I can't have those days off every week along the lines of "we don't do that here" and "if we do this for you everyone will do it." I can very easily nail her to the wall and I feel opted to I can talk to the main guy who owns the whole operation in Florida and get her canned for her BS.

A check of mine bounced once and I reported them... got them fined big time. They told me "don't cash that for 10 business days because the money won't be there." So I cashed it immediately and when there was no money... I called the Federal Labor Board and they pounced on them the next day. The papers are in the break room... most of them are from 2005 and 206... I haven't seen a single paper in there from the last 2 years. There's also been a big discrepancy there about work attire. As far as I'm aware... if a job requires a dress code, they must be willing to provide the clothing they require you to where. At my last job... my boss tried for 2 years to get me to where "what was required" and every time I told her to get someone to write me a check for the clothes or piss off... and she never even tried to write me up. How ever in this situation... management is allowed to where what ever they want but the bottom feeders are not... which doesn't fly. Also... one of the guys lost his step-dad in an auto accident 2 weeks ago... and they told him he WASN'T ALLOWED to go to the funeral because it was during his scheduled shift and he was on attendance probation and they'd fire him if he went! I told him to go straight to a lawyer and he won't do it... friggin' irritating.

remind yourself this as well.. they need you more than you need them. took me a loong time to realize that at the first ****ty job i took. I was in the same situation as you cept I was still part of the union at the time. the supervisor did everything she could to prevent me from asking or even trying to get a promotion. she also called a person with downs sydrom "shrek" the downs syndrom person didn't realize what she called her but everyone else in earshot of that knew what she meant. I'm surprised the bitch hasn't been fired... oh wait I forgot she is best friends with the HR person.
